Hepco&Becker offers its customers a voluntary five-year manufacturer's guarantee. In addition to the statutory warranty that the consumer is entitled to from his seller, we assume this manufacturer's guarantee towards consumers for products. It applies without prejudice to mandatory statutory liability regulations, such as under the Product Liability Act, in cases of intent and gross negligence, due to injury to life, limb or health by Hepco&Becker or its vicarious agents. "Consumer" within the meaning of this manufacturer's warranty is any natural person who owns the product and has not purchased it with the intention of reselling it or installing it for third parties as part of their commercial or independent professional activity. "Initial Customer" is the consumer who first purchased the product from Hepco&Becker, a dealer or other person or entity who resells or installs the product in the course of his commercial or independent professional activity. In addition to the rights arising from the guarantee, the buyer is entitled to the statutory warranty. These rights, which may be more favorable for the buyer, are not restricted by the guarantee. The guarantee also does not affect the rights that the first customer and, where applicable, the consumer have against the seller from whom the first customer purchased the product. This manufacturer's warranty only covers Hepco&Becker products that meet all of the limitations and exclusions listed below and that have proof of purchase date January 2016 or later.
This guarantee is valid for a period of 5 years from the date of purchase by the first customer, but no longer than 6 years after manufacture. The warranty period is not extended due to the granting of services within the scope of this warranty, especially not in the case of repair or replacement. In these cases, the warranty period does not start again. If you purchased from a dealer: Please note that you must inform your dealer immediately (or within a reasonable period of time, depending on the type of abnormality) of any abnormalities that you have identified.
- Defekte, die nicht durch Material-oder Verarbeitungsmängel bedingt sind.
- Diese Garantie gilt nicht für Ansprüche wegen mangelhafter Konstruktion. Ferner sind Schäden durch höhere Gewalt, Unfallschäden, normaler Verschleiß und Abnutzung, Missbrauch oder unsachgemäßer Umgang von dieser Garantie ausgeschlossen. Des Weiteren deckt diese Garantie ein Motorrad, ein Bauteil oder ein Teil desselben dann nicht ab, wenn es strukturell verändert bzw. modifiziert wurde oder vernachlässigt, unzureichend gewartet bzw. für Renn- oder zu sonstigen Zwecken verwendet wurde, für die es nicht konstruiert und gefertigt wurde.
- Schäden oder Defekte, die durch unsachgemäße Wartung; Oberflächenmängel infolge externer nicht gebrauchsüblicher Beanspruchung, Hitze, Kälte oder Verunreinigung; Fahrerfehler oder missbräuchliche Verwendung; unsachgemäße Ausrichtung, Spannung, Einstellung oder Höhenanpassung von Komponenten; unsachgemäße Wartung; modifizierte Komponenten; Verwendung von Nachrüst- oder nicht genehmigter Komponenten, Zubehörartikeln oder Anbauten; Reparaturen nach Ablauf der Garantiezeit.
- Schäden oder Defekte, die durch Missbrauch, Unfall, Brand oder sonstige Ursachen bewirkt wurden, die nicht auf Material- oder Verarbeitungsmängel zurückzuführen sind.
- Diese Garantie deckt keine persönlichen Verluste oder Aufwendungen ab, beispielsweise zurückgelegte Kilometer, Transportkosten, Hotelunterbringung, Mahlzeiten, Versand- und Umschlagskosten, Abholung oder Anlieferung von Motorrädern, Ersatz-Mietfahrzeuge, Verlust der Fahrzeugnutzung, entgangene Gewinne oder Verlust von Urlaubstagen oder Freizeit.
The exclusive remedy for breach of this warranty shall be, at Hepco&Becker's option, repair or replacement of any defective material, component or product. Any other rights under this guarantee are excluded. Any statutory rights you may have in relation to defects in your motorcycle under applicable law are not affected by this warranty.
A notice:
To the extent any of the above provisions are superseded by federal, state or local law, all other warranty terms shall continue in effect. Please discuss any warranty cases with your sales contract partner. If they need additional support, they can get in touch with the responsible contact person at Hepco&Becker.
Place of Performance, Place of Jurisdiction and Applicable Law:
German law applies to this guarantee, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) of April 11, 1980. The place of performance for the obligations arising from this guarantee is Pirmasens, Germany. As far as permissible, the place of jurisdiction is Pirmasens, Germany.
